This notice describes how medical information is used and disclosed and the privacy practices of DAYSTAR BILLING SERVICES, LLC.

We reserve the right to change our practices and to make the new provisions effective for all protected health information we maintain. Should our information practices change, we will post these revisions on our Website.

We will not use or disclose your patient’s health information without your authorization, except as described in this notice.

Our Policy:

§         Protected Health Information and other confidential information will not be shared with any unauthorized individuals in written, verbal or electronic form.  Such information will be kept secure and accurate. 

§         Any Individually Identifiable Health Information about a patient or his or her treatment that is inadvertently sent to or received by DAYSTAR BILLING SERVICES, LLC is strictly confidential and will not be shared in written, verbal or electronic form, except to be returned to the sender, when appropriate. 

§         Any paper documents containing Protected Health Information will be in locked and/or attended areas to prevent unauthorized access.

§         Confidential information in electronic format, including electronic databases and records, may only be accessed by individually authorized passwords.  All such electronic information will be backed up on a regular basis and a copy of the back up will be kept in a secure off site location.

§         When Individually Identifiable Health Information inadvertently sent to/or received by DAYSTAR BILLING SERVICES, LLC is discovered, the entity that transmitted or sent that information will be immediately notified.  That information will be returned and then permanently deleted and/or destroyed

§         No employees of DAYSTAR BILLING SERVICES, LLC, including billing support staff, may issue any Protected Health Information, in written, verbal or electronic format, to persons outside of  DAYSTAR BILLING SERVICES, LLC except as authorized by our clients.

§          All confidential information communicated or electronically transmitted outside of DAYSTAR BILLING SERVICES, LLC will be identified as such.  Protective measures will be taken, as appropriate, to keep that information confidential and secure.  For example:

►All faxes containing Protected Health Information will be identified as such with a cover sheet.

►All e-mail communications containing confidential information will be identified as confidential and encrypted when possible.

§         When violations of this policy are discovered they will be documented and reported to the owner and/or business manager of DAYSTAR BILLING SERVICES, LLC.  Appropriate disciplinary measures, from verbal warnings to formal dismissal, will be taken as per the discretion of the DAYSTAR BILLING SERVICES, LLC.

Examples of Disclosures for Treatment, Payment, and Health Operations

We will use your patient’s health information for payment.

For example:

►A bill may be sent to your patients and the information on or accompanying the bill may include information that identifies patients, as well as diagnosis, procedures, and supplies used.

►A third –party payer may request a copy of an itemized statement and/or a copy of the medical records.  This information may include information that identifies patients, as well as diagnosis, procedures and supplies used.

Unpaid patient accounts may be turned over to an outside collection agency and the data may include information that identifies patients, as well as diagnosis, procedures and supplies used.

Business associates: There are some services provided in our BILLING AGENCY through contacts with business associates. When these services are contracted, we may disclose your patient’s health information to our business associate so that they can perform the job we’ve asked them to do and bill a third-party payer for services rendered. To protect your patient’s health information, however, we require the business associate to appropriately safeguard your patient’s information.

If you believe our billing agency has violated the rights of your patient’s or any of the HIPAA standards, you can file a complaint with Jennifer Jones, Owner and Manager or with the secretary of Health and Human Services. There will be no retaliation for filing a complaint.
